NIMH Chemical Synthesis and Drug Supply Program Terms
DELIVERY: We will make every effort to ensure prompt processing and delivery of orders once the proper paperwork has been completed and appropriate approvals obtained; however, we assume no responsibility for delay or non-delivery by the carrier. In order to avoid storage under improper conditions resulting from delays in transit, we generally will not make shipments Friday through Sunday.
INFORMATION AND ASSISTANCE: We will include a data sheet with each compound to inform you of the estimated purity and to summarize any special handling precautions. If you encounter specific problems with any of our compounds, please let us know. We will be happy to provide technical information and assistance with respect to the synthesis protocols and analytical methodology. In general, you should consider all of the repository compounds as sensitive to light (particularly short wave ultraviolet), heat and oxidizing agents. Unless specified otherwise, all repository compounds are provided only for research and development purposes, not for human, food, drug, cosmetic or household use.
Over time we will be adding pertinent references about the repository compounds to the compound information pages (browse the catalog). If you are aware of a key reference that should be cited, please let us know.
Please note that if you cannot find the compound you need, you may make a synthesis request. NIMH will approve/deny and prioritize synthesis requests.
RADIOACTIVE MATERIALS LICENSE: Compliance with institutional, state, and national regulations for the procurement of radioactive materials is the responsibility of the requestor. Users of radioactive mate-rials should familiarize themselves with all applicable regulations.
In the United States, the use and possession of radioactive materials are governed by regulations issued by the U.S. Nuclear Regulatory Commission (NRC) and published in the Federal Register in Title 10, Code of Federal Regulations, Part 30. United States federal regulations require that a copy of a requestor’s license, together with all amend-ments, be on file at the contractor’s office (RTI International, Research Triangle Park, NC) before any shipment of radioactive material can be made.
USAGE, TOXICITY, AND HAZARDS NOTICE: As noted above, repository compounds are offered only for research and development purposes. We cannot be certain of your application of the enclosed chemicals. Therefore, we offer no warranties regarding their use, nor will we be responsible for any loss resulting from use of the chemicals. However, if the chemicals are proven to be defective, the purchase price will be returned to the purchaser upon proof of purchase. We expressly disclaim any warranties of merchantability or fitness for a particular purpose.
LIMITATION ON CONSEQUENTIAL DAMAGES AND INDEMNIFICATION: The requestor’s exclusive remedy with respect to chemicals proved to the NIMH’s satisfaction to be defective or nonconforming shall be the return of such chemicals to the NIMH’s contractor as provided herein and refund of the purchase price if applicable. The NIMH and its contractors have no other obligations or liabilities, whether arising out of breach of contract, warranty, tort or other theories of law, with respect to chemicals acquired from the NIMH Repository. In addition, the NIMH and its contractor specifically disclaim any liability for personal injury or property damages, loss of profits or revenues, loss of use of products or any associated equipment, the cost of substitute products, facilities or services, downtime, shut-down or slow-down costs, or for other economic loss and claims of any third party. The requestor shall indemnify the NIMH and its contractor for all losses, damages, and expenses (including attorney’s fees and other cost of defending any action) that the NIMH or its contractor may sustain or incur as a result of any claim by the purchaser, its agents, officers, employees, successors, assigns, customers, or other persons in connection with use of the products furnished hereunder.
RETURN SHIPMENTS The repository will not accept return shipments unless prior permission has been given and shipping instructions have been provided. We will make every effort to cooperate with the requestor, but circumstances involving returns are frequently complicated and peculiar to individual requestors, and require individual attention and specific handling. Unidentified returned shipments may be discarded due to our quality control standards. In the event that a complaint relating to the quality of a product is deemed to be valid and justifiable, then, at our option, we will either replace the quantity free of charge or issue a credit for the quantity in question.
