Terms and Conditions

DELIVERY: Every effort will be made to ensure prompt request processing and compound delivery once the proper approvals have been obtained, but RTI and the NIMH assume no responsibility for delay or non-delivery by the carrier. In order to avoid storage under improper conditions resulting from delays in transit, shipments are generally not made Friday through Sunday.

INFORMATION AND ASSISTANCE: A data sheet will be included with each compound containing the estimated purity and summarizing any special handling precautions. If specific problems are encountered with any compounds, please contact the CSDSP for technical assistance. In general, all compounds should be treated as sensitive to light (particularly short wave ultraviolet), heat and oxidizing agents. Unless specified otherwise, all compounds are provided for research and development purposes only, not for human, food, drug, cosmetic or household use.

RADIOACTIVE MATERIALS LICENSE: Compliance with institutional, state, and national regulations for the procurement of radioactive materials is the responsibility of the requester. Users of radioactive mate-rials should familiarize themselves with all applicable regulations.

In the United States, the use and possession of radioactive materials is governed by regulations issued by the U.S. Nuclear Regulatory Commission (NRC) and published in the Federal Register in Title 10, Code of Federal Regulations, Part 30. United States federal regulations require that a copy of a requester's license, together with all amend-ments, be on file at RTI before any shipment of radioactive material can be made.

USAGE, TOXICITY, AND HAZARDS NOTICE: Compounds are provided for research and development purposes only. We cannot be certain of your application of the enclosed chemicals. Therefore, we offer no warranties regarding their use, nor will we be responsible for any loss resulting from use of the chemicals. However, if the chemicals are proven to be defective, the purchase price will be returned to the purchaser upon proof of purchase. We expressly disclaim any warranties of merchantability or fitness for a particular purpose.

LIMITATION ON CONSEQUENTIAL DAMAGES AND INDEMNIFICATION: The requester's exclusive remedy with respect to compounds proved to the NIMH's satisfaction to be defective or nonconforming shall be the return of such compounds to RTI as provided herein and refund of the purchase price if applicable. The NIMH and RTI have no other obligations or liabilities, whether arising out of breach of contract, warranty, tort or other theories of law, with respect to compounds acquired from the NIMH CSDSP. In addition, the NIMH and RTI specifically disclaim any liability for personal injury or property damages, loss of profits or revenues, loss of use of products or any associated equipment, the cost of substitute products, facilities or services, downtime, shut-down or slow-down costs, or for other economic loss and claims of any third party. The requester shall indemnify the NIMH and RTI for all losses, damages, and expenses (including attorney's fees and other cost of defending any action) that the NIMH or RTI may sustain or incur as a result of any claim by the purchaser, its agents, officers, employees, successors, assigns, customers, or other persons in connection with use of the products furnished here6under.

RETURN SHIPMENTS The NIMH CSDSP will not accept return shipments unless prior permission has been given in writing and shipping instructions have been provided. Every effort will be made to cooperate with the requester, but circumstances involving returns are frequently complicated, unique to individual requesters, and require individual attention and specific handling. Unidentified returned shipments may be discarded due to quality control standards. In the event that a complaint relating to the quality of a product is deemed to be valid and justifiable, the CSDSP at its optional discretion may replace or issue a credit for the compound.

About The Program

Since 1959, the NIMH Chemical Synthesis and Drug Supply Program has synthesized and distributed novel research chemicals, psychoactive drugs, and compounds that are unavailable from commercial sources to the scientific community working on research relevant to mental health.
